1. Subject and scope

These General Conditions of Sale govern the purchase of products through the website of Matcon Integral, S.L. (hereinafter, "the Seller") by individuals or legal entities acting as consumers or end users (hereinafter, "the Customer"). Consumers are considered to be individuals or legal entities acting outside a business or professional activity, in accordance with Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU).

Sales made to professionals or companies shall be governed by the specific conditions expressly agreed with the Seller, the present conditions being subsidiarily applicable insofar as they are compatible with civil and commercial regulations.

2. Seller identification

3. Purchase procedure

The Customer may place orders through the website following the procedure established therein, which includes the selection of products, the completion of shipping and billing data, and the final confirmation of the order. Once confirmed, the Seller shall send the Customer an order confirmation to the email address provided, together with these Conditions and, where applicable, the withdrawal document.

The contract shall be deemed to be formalised at the moment when the Customer expresses final consent by clicking the confirmation button provided for that purpose.

4. Prices and shipping costs

The prices of the products are those indicated on the website at the time the order is placed, and include Value Added Tax (VAT) at the applicable current rate.

Shipping costs, if any, are indicated to the Customer prior to the confirmation of the order and are broken down in the purchase summary.

5. Payment methods

The Customer may pay using the payment methods indicated on the website at the time the order is placed.

6. Delivery time and place

The approximate delivery time is indicated for each product and is confirmed to the Customer in the order confirmation. Delivery is made to the address indicated by the Customer within the Seller's delivery area.

In the event of a delay in delivery exceeding thirty days from the approximate confirmed deadline, and provided that the delay is attributable to the Seller, the Customer may withdraw from the contract in accordance with Articles 103 et seq. of the TRLGDCU.

7. Right of withdrawal

Under Articles 68 et seq. of the TRLGDCU, the Customer has a legal right to withdraw from the contract within fourteen calendar days. The Seller voluntarily extends this period to thirty (30) calendar days from receipt of the product or from the in-store purchase, without giving any reason and without any penalty or fee. Within the same period, the Customer may instead exchange the product for another one from the catalogue.

To exercise this right, the Customer must notify the Seller in writing (email to info@matcon-integral.com or post to the address indicated) within the indicated period, by means of the withdrawal form provided with the order confirmation, or by any other unequivocal statement of the decision to withdraw from the contract.

Once the decision has been communicated, the Customer must return the product within the 30-day period, at the Seller's store or by post or courier to its address, new, unused, not installed and in its original packaging. The Seller does not provide return labels; the direct costs of return are borne by the Customer, except in cases of lack of conformity or shipping error. Full details are set out in the Return Conditions.

The Seller shall refund the amount paid for the product, free of fees, within a maximum of seven (7) days of receiving the returned goods, using the same payment method used by the Customer.

Exceptions to the right of withdrawal

The right of withdrawal shall not apply in the cases provided for in Article 103 of the TRLGDCU, and in particular in the following cases:

  • Products made to the Customer's specifications or clearly personalised.
  • Sealed products which are not suitable for return due to health or hygiene protection reasons and which have been unsealed after delivery.

8. Legal warranty

In accordance with Articles 114 et seq. of the TRLGDCU, the Seller is liable for any lack of conformity that becomes apparent within three years of delivery of the product.

In the event of a lack of conformity, the Customer may choose between repair or replacement of the product, unless one of these options is impossible or disproportionate, in which case the Customer may request a price reduction or termination of the contract.

The commercial warranty offered by the product manufacturer shall be governed by the conditions established by said manufacturer.

9. Complaints

The Customer may submit complaints and claims by email to info@matcon-integral.com. The Customer also has at their disposal the official complaint forms of the Valencian Community, which may be requested at the Seller's physical establishment or through the email address indicated.

10. Applicable law and jurisdiction

These Conditions are governed by Spanish law.

For the resolution of any dispute arising from the interpretation or application of these Conditions, the parties expressly submit to the Courts and Tribunals of the place of residence of the consumer when the latter has the status of consumer, and to the Courts and Tribunals of the city of Valencia in all other cases.
